J&K&L HC: Custody Can't Favor Either Parent Solely Based On Gender; Constitution Forbids Bias - (12 Sep 2025)

J&K & Ladakh HC upheld constitutional equality, ruling custody can't favor a parent solely by gender. Justice Wani, allowing a mother’s appeal, cited Articles 14 & 15 of Constitution, stressing child welfare as the sole factor in custody decisions, rejecting gender-based presumptions or preferences.
