J&K&L HC: Appellate Court Can Enhance Accident Compensation U/O O XLI R 33 CPC without Cross Appeal - (09 Sep 2025)

MOTOR VEHICLES

J&K&L High Court ruled that in motor accident appeals, the court can enhance compensation even without a claimant's cross-appeal. If the Claims Tribunal’s award is inadequate, the appellate court has the power to modify and increase the compensation to ensure fair justice for the claimant.
