SC: Anticipatory Bail Allowed under SC/ST Act Only if Prima Facie Offense isn't Established - (04 Sep 2025)

CRIMINAL

SC has ruled that anticipatory bail under SC/ST Act can only be granted if no prima facie offense is established. It noted that if accusations u/s 3 of the Act lack merit and the offense is not clearly made out, courts can exercise discretion to grant anticipatory bail under Section 438 of CrPC.
