SC: Clause Limiting Interest on Delayed Payments Doesn’t Bar Pendente Lite Interest under A&C Act - (03 Sep 2025)

ARBITRATION

Supreme Court has held that an arbitral tribunal can award pendente lite interest unless the contract explicitly or implicitly bars it. A clause restricting interest on delayed payments alone doesn’t amount to a bar on pendente-lite interest during arbitration proceedings.
