NCLAT: NCLT/NCLAT Cannot Adjudicate Employment Contract Disputes Under IBC - (09 May 2025)

INSOLVENCY

NCLAT bench of New Delhi has held that under IBC, 2016 National Company Law Tribunal (NCLT) or the NCLAT cannot adjudicate a dispute arising from an employment contract concerning the determination of emoluments and salaries to be paid to an employee of a company after his termination.
