SC: Clause for Forfeiture of Earnest Money is Not Penal in Ordinary Sense - (05 May 2025)

CONTRACT

Supreme Court has observed that a clause for the forfeiture of earnest money is not penal in the ordinary sense, rendering Section 74 of the Indian Contract Act 1872, inapplicable.
