SC: Can’t Reject Plaint as Time Barred When Limitation is Mixed Question of Fact & Law - (01 May 2025)

Supreme Court has held that a plaint cannot be rejected on the ground of limitation when the issue of limitation is a mixed question of fact and law and such issues cannot be decided summarily without allowing the parties to lead evidence on the arising of the cause of action.
