NCLAT: Can’t Use Section 94 of IBC to Hinder Recovery Process under SARFAESI Act - (28 Apr 2025)

INSOLVENCY

NCLAT New Delhi bench has held that Section 94 of the Insolvency and Bankruptcy Code, 2016 cannot be misused to obstruct legitimate recovery under SARFAESI Act, 2002.
