NCLAT: Can’t Entertain Petition u/s 7 of IBC during Moratorium Period Under Restructuring Proposal - (21 Apr 2025)

INSOLVENCY

NCLAT New Delhi bench has held that debenture holders cannot be permitted to file an application under Section 7 of the Insolvency and Bankruptcy Code, 2016 until the expiry of moratorium period once they have acted upon the restructuring proposal given by CD which included a moratorium.
