NCLT: Can’t Call Speculative Investment a 'Financial Debt' in Absence of Commercial Effect of Borrowi - (07 Apr 2025)

INSOLVENCY

NCLT New Delhi bench while dismissing an application under Section 7 of the Insolvency and Bankruptcy Code (IBC), 2016 has held that a speculative investor cannot claim status and benefits as a 'financial creditor' in absence of interest in financial well-being of Corporate Debtor.
