NCLAT: Can’t Lay Down Straight Jacket Formula for Adjudication of Application u/s 12A of IBC - (10 Mar 2025)

INSOLVENCY

NCLAT New Delhi bench has held that for adjudication of application under Section 12A of Insolvency and Bankruptcy Code, 2016 by the Adjudicating Authority, no straight jacket formula can be laid down.
