NCLAT: Cannot Consider Serving Demand Notice to Personal Guarantor as Invocation of Guarantee - (03 Mar 2025)

INSOLVENCY

NCLAT New Delhi bench has held that notice under Rule 7 of Insolvency and Bankruptcy (Application to Adjudicating Authority for Insolvency Resolution Process for Personal Guarantors to Corporate Debtors) Rules, 2019 served to personal guarantor cannot be considered as 'Invocation of Guarantee'.
