Bom. HC: Can Apply Business Efficacy Test if Ambiguity in Arbitration Agreement - (14 Feb 2025)

ARBITRATION

Bombay High Court has held that business efficacy test can be applied to recognize the intent of parties if there is any ambiguity in the arbitration agreement.
