NCLT: No Establishment of Creditor-Debtor Relation from Arrangement Involving Joint Profit-Sharing - (12 Feb 2025)

INSOLVENCY

National Company Law Tribunal Delhi bench has held that if the business arrangement between the parties involves joint participation and profit-sharing, such arrangement does not establish a debtor-creditor relationship under the Insolvency and Bankruptcy Code, 2016 (IBC).
