Del. HC: In TM Infringement Cases, Court has Jurisdiction if Goods Accessible in their Territory - (07 Feb 2025)

INTELLECTUAL PROPERTY RIGHTS

Delhi High Court has observed that in a trademark infringement suit, if a party is not physically selling goods in a particular territory but the goods are accessible within the territory through a website then the Court having jurisdiction over the territory can try the matter.
