SC: Right to Maintenance Shall Have Overriding Effect on Rights of Claimants under SARFAESI/IBC - (12 Dec 2024)

CRIMINAL

SC has stated that the right to maintenance being equivalent to a fundamental right will be superior to and have overriding effect on the statutory rights afforded to Financial Creditors, Secured Creditors, Operational Creditors or any other such claimants encompassed within SARFAESI Act, IBC.
