Raj. HC: MACT Empowered to Recall Order if Obtained through Fraud or Misrepresentation - (20 Sep 2024)

MOTOR VEHICLES

Raj. HC has held that generally a Motor Accidents Claims Tribunal does not have the jurisdiction to deal with a review application under Order 47 of Code of Civil Procedure, 1908 (CPC) but if an order has been obtained through fraud or misrepresentation, it can recall the order through a review.
