Ker. HC: Consent on Sexual Relationship to be Decided in Trial If Allegation are Made Out Prima Facie - (06 Aug 2024)

CRIMINAL

Kerala High Court while refusing to quash rape proceedings against the accused, has held that in a case where the prosecution allegation are made out prima facie then consent on sexual relationship on misconception of fact on the promise of marriage, is a matter to be decided during evidence.
