SC: Inclined to Hold That Accused in One Case Shouldn’t be Denied Anticipatory Bail in Another Case - (07 May 2024)

CRIMINAL

SC has observed that it is prima facie of the view that Section 438 of the Code of Criminal Procedure, 1973 cannot be stultified and if a person is under arrest for an offence, he cannot get anticipatory bail in that case but he is entitled to get anticipatory bail in other, subject to a hearing.
