SC: Can Only Apply Egg Shell Skull Rule if Patient Had Pre-Existing Conditions - (25 Apr 2024)

LAW OF MEDICINE

Supreme Court While enhancing the compensation amount for a patient from Rs. 2 Lakh to Rs. 5 Lakh, has observed that the egg shell skull rule that holds the injurer liable for damages suffered, shall only be applicable if the patient had pre-existing conditions.
