SC: Sessions Judge has Power to Issue Process Against Accused in Offences Under IBC, 2016 - (22 Apr 2024)

INSOLVENCY

SC while upholding issuance of process by sessions judge in an offence committed under Insolvency and Bankruptcy Code, 2016 (IBC), has observed that Sessions Judge is empowered to issue process against accused, despite amendment in Companies Act, 2013 that vests jurisdiction on Judicial Magistrate.
