Del HC: Invoking Penalty Proc. Based on NFAC’s Own Failure to Lodge Claim Can’t be Sustained by them - (19 Apr 2024)

INSOLVENCY

Delhi High Court has held that invocation of penalty proceedings that are based on the National Faceless Assessment Centre’s (NFAC) own failure to lodge a claim on time under the Insolvency and Bankruptcy Code, 2016 (IBC) cannot be sustained by them.
