Massimilano Latorre and ors. v. Union of India and ors. - (Supreme Court) (26 May 2016)

Italian marine allowed to return home

Marine Laws

Sergeant Major Salvatore Girone, one of two marines implicated in the shooting of several Kerala fishermen, has been allowed to return to Italy.

The Supreme Court was adamant that Girone would have to remain under the authority of the Supreme Court of India. Furthermore, he has been ordered to surrender his passport to Italian authorities, and permission to travel outside Italy will have to be sought from the court.

Jurisdictional lines, vague at best in an international setting, are beset by a paranoia of non-compliance. Perhaps alluding to the same, the court also imposed a litany of conditions for regular updates on the whereabouts of the Italian marine and undertakings from Italian representatives to produce him before the court when asked to do so.
