Del. HC: Goodwill/Reputation Acquired After ‘Terminus Ad Quem’ is of No Consequence - (02 Jan 2024)

INTELLECTUAL PROPERTY RIGHTS

Delhi High Court has observed that terminus ad quem, by which date the plaintiff has to prove the acquisition of the requisite goodwill for a plea of passing off to succeed, is the date of commencement of the rival mark; Goodwill acquired in the asserted mark, after that date, is of no consequence.
