Bom HC: No Appeal Under Commercial Court Act Against Court Order Refusing to Return/Reject a Plaint - (20 Dec 2023)

CIVIL

Bombay High Court has held that the Trial Court’s order refusing to return or reject a plaint is not appealable under the Commercial Courts Act, 2015, and observed that appeal shall lie only from orders that are specifically enumerated under Order XLIII of the CPC.
