Ker. HC: Mere Uploading of Appln. u/s 96 IBC Can’t be Considered as Filing - (20 Nov 2023)

INSOLVENCY

Kerala High Court has held that only when an application under Section 96 of IBC is filed without any defects and satisfying the statutory procedural requirements of filing and only when the adjudicating authority numbers the application, there can be a legal and acceptable filing of application.
