SC: Essential to Examine the Person who Recorded Dying Declaration - (08 Nov 2023)

LAW OF EVIDENCE

Supreme Court has held that dying declaration, although undoubtedly a substantive piece of evidence upon which reliance can be placed, it can be rendered nugatory if the person who took down such declaration is not examined.
