Ker. HC: Non-Compliance of MSME Framework Doesn’t Nullify NPA Declaration Under SARFAESI - (15 Sep 2023)

Kerala High Court has held that failure to abide by the terms of the notification of 2015 prescribing ‘Framework for Revival and Rehabilitation of Micro, Small and Medium Enterprises' cannot render the declaration of the account as NPA under SARFAESI Act, void or bad in law.
