Pat. HC: Non-Determination of POCSO Victim’s Age Causes Prejudice to the Fair Trial - (19 Jul 2023)

CRIMINAL

Patna High Court has held that non-determination of victim’s age as per Section 34(2) of POCSO Act causes prejudice to fair trial. Non-compliance with such procedural requirements amounts to a failure of justice and the benefit should certainly go in favor of the accused.
