Kar HC: For Application of S.306 IPC, Proximate to the death must be a Positive Act of Instigation - (22 Jun 2023)

CRIMINAL

Karnataka High Court while quashing prosecution initiated against a couple under section 306 IPC, has held that to establish proximity to death, it must be a dynamic act, proximate to the occurrence of death and should be instigation of a kind that it drives a person to commit suicide.
