All. HC: No Sanction Needed to Prosecute Public Servant if CBI Probed Case Upon HC/SC’s Order - (01 Dec 2022)

CRIMINAL

Allahabad High Court has held that if CBI has probed a matter upon direction of High Court or Supreme Court and has filed a charge sheet against a public servant, then there is no requirement to obtain sanction from the competent authority for prosecuting such a public servant.
