Kerala HC: POCSO Act Prevails Over SC/ST Act - (27 Oct 2022)

CRIMINAL

Kerala High Court has held that Protection of Children from Sexual Offences Act, 2012 (POCSO) prevails over SC/ST (Prevention of Atrocities) Act, 1989 (SC/ST Act); thus, when offences under both Acts have been alleged, accused would be entitled to avail procedure contemplated under former for bail.
