Vellore Citizens Welfare Forums and Ors. v. Union of India and Ors. - (High Court of Madras) (07 Apr 2016)

Loss of Ecology Authority shuttered

MANU/TN/0502/2016

Environment

The Loss of Ecology Authority, functioning intermittently to entertain claim petitions form farmers seeking compensation for damage caused to agricultural fields, is to be wound up by 30 June 2016.

Constituted after a 1996 Supreme Court judgment, the Authority predated the National Green Tribunal, which was birthed in 2010. The Court dismissed calls for making the Authority a permanent body, rejecting, amongst other submissions, that the body had a broader gamut of powers than the Tribunal and being a special state body it would function more effectively than the national Tribunal.

Staff employed with the Authority has been directed to be absorbed by the NGT, and claims before the Authority have been transferred to the Tribunal as well.
