Delhi HC: Plaintiff Not Entitled to Refund of Court Fees when Parties Referred to Arbitration - (27 May 2022)

CIVIL

Delhi High Court has held that the plaintiff is not entitled to refund of court Fees when the parties are referred to arbitration under Section 8 of the Arbitration & Conciliation Act. The benefit of refund is available only when parties are referred to arbitration under Section 89 of the CPC.
