Delhi HC: Nominative Fair Use Permissible If it Does Not Depict Sponsorship by Trademark - (26 Apr 2022)

INTELLECTUAL PROPERTY RIGHTS

Delhi High Court has ruled that the nominative fair use is permitted in so far as the use is such that it does not illustrate sponsorship by the trademark owner and the use is reasonably necessary.
