Telangana HC: Arbitral Award A Nullity If Passed Beyond Prescribed Period - (15 Apr 2022)

ARBITRATION

Telangana High Court has held that the provisions of Section 29A of the Arbitration and Conciliation Act, 1996 (A&C Act) are cast in mandatory terms and the mandate of the arbitrator terminates under Section 29A(4) after the expiry of the prescribed period, making the arbitrator functus-officio and the award passed by him a nullity.
