Delhi HC: Continuing Cause of Action in Trademark Suits No Defence to Multiple Proceedings - (11 Apr 2022)

INTELLECTUAL PROPERTY RIGHTS

Delhi High Court has held that a trademark owner cannot drag a Defendant to multiple fora, being a higher court or before a court of coordinate jurisdiction, when the matter is pending before the first Court, when the matter is part heard before the first Court, to find a forum to get relief.
