Delhi HC: Invocation of S. 13 SARFAESI Act Results in General Bar to Civil Court Proceedings - (03 Feb 2022)

Delhi High Court has held that invocation of Section 13 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 results in a general bar to civil court proceedings, in light of Section 34 of the Act. However, this general rule is subject to the exceptions of fraud or absurd claims by the secured creditor.
