Madras High Court: Proceeding Under NI Act Cannot be Initiated During Moratorium - (31 Jan 2022)

Madras High Court has held that as long as a moratorium under Section 14 of the Insolvency and Bankruptcy Code is imposed, proceedings under Section 138/141 of the Negotiable Instruments Act, 1881 cannot be initiated against the Corporate Debtor.
