SC: Illegal Use of Licensed Weapon Per Se Not Offence Unless Misdemeanour Proved - (29 Nov 2021)

CRIMINAL

Supreme Court has observed that illegal use of a licensed or sanctioned weapon per se does not constitute an offence under Section 27 of the Arms Act, 1959, without proving the misdemeanour under Section 5 or 7 of the Act. The Court has observed that at best, it could be a misconduct under the service rules.
