SC: Plea of Res Judicata Can Be Determined as Preliminary Issue - (24 Sep 2021)

CIVIL

Supreme Court observed that plea of res judicata can be determined as a preliminary issue only when it only involves adjudication of question of law. The Court has observed that when a mixed question of law or fact is raised, the issue should await a full-fledged trial after evidence is adduced.
