SC: Permissible to Hold Discrete/Open Inquiry at Pre-FIR Stage in Corruption Cases - (25 Mar 2021)

CRIMINAL

Supreme Court has observed that it is permissible to hold discrete/open enquiry, at pre-FIR Registration stage more particularly in cases where the allegations are of misconduct of corrupt practice acquiring the assets/properties disproportionate to his known sources of income. The Court has added that, even at the stage of registering the first information report, the police officer is not required to be satisfied or convinced that a cognizable offence has been committed.
