SC: Delay in Filing Appeals Beyond 90, 60 or 30 Days Can be Condoned - (22 Mar 2021)

ARBITRATION

Supreme Court has overruled its 2019 verdict in the case M/s NV International vs State of Assam which had strictly held that a delay of more than 120 days in filing of appeals under Section 37 of the Arbitration and Conciliation Act 1996 cannot be condoned. The Court has held that delay beyond 90, 60 or 30 days for filing appeals under Section 37, depending on the forum, can be condoned, but such condonation of delay should be an exception and not the norm.
