Info Edge (India) Ltd. v. Rakesh Kalia - (High Court of Delhi) (15 Dec 2015)

Court looks to cut spam on Naukri.com

MANU/DE/4355/2015

Intellectual Property Rights

Delhi High Court allowed a suit for injunction by Info Edge, the company that runs the well-known job portal ‘Naukri.com’, against a person who registered ‘www.naukrinews.com’. Defendant used the similar-sounding domain name to send emails to customers registered on naukri.com, and attempted to use their profiles on his portal as well. The Court accepted submissions that Defendant was using the similarity in domain names to pass itself off as a sister concern of Plaintiff; Plaintiff’s, customers were being duped into paying for services which they assumed to be emanating from it. An interim injunction preventing Defendant from using his mark ‘NaukriNews’, and domain names similar to ‘Naukri’ was granted.
