Kerala HC: Court Can Declare Property Free of Encumbrance Against Will of Encumbrancer - (10 Aug 2020)

Kerala High Court has stated that as per Section 57 of the Transfer of Property Act, 1882, Courts have the power to declare a property free of encumbrances even against the will of the encumbrancer.
