Bombay HC: To Attract Section 3(1) (s), Event Must Happen Both in Public and in Presence of Public - (30 Sep 2019)

CRIMINAL

Bombay High Court has ruled that insult or humiliation must take place in the presence of or in the proximity of atleast one independent public witness in order for the offence to qualify as atrocity under Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015.
