Bombay HC: Ex Parte Decree Can Be Passed in Notice of Motion Filed Under Original Side Rules Only - (28 Dec 2017)

Bombay High Court has held that on its original side, an ex parte decree can be passed in a notice of motion filed only under Rule 90 of the Original Side Rules and not under Order VIII of the Code of Civil Procedure.
