High Court reinforces importance of wearing helmet while riding two-wheeler

The Madras High Court directed the government to take several proactive steps in tackling death and injury caused in accidents due to two-wheeler riders not wearing helmets. Aside from publicising impounding of drivers’ licences for failure to wear helmets, the Court ordered installation of CCTV cameras at important junctions, roads and highways. Perhaps most notably, it delved into the technical specifications of helmets with regards to visibility and called for assessment of helmet design for safety and visibility. The Court also reiterated that under Rule 138(4)(f) of the Central Motor Vehicle Rules, 1989, ‘at the time of purchase of the two wheeler, the manufacturer of the two wheeler shall supply a protective headgear conforming to specifications prescribed’.
