SC: Bail Shouldn’t be Opposed for Seriousness of Offence if Prosec. Agency Can’t Ensure Speedy Trial - (05 Jul 2024)

CRIMINAL

SC has observed that if any prosecuting agency has no wherewithal to provide or protect the fundamental right of an accused to have a speedy trial as enshrined under Article 21 of the Constitution then prosecuting agency should not oppose plea for bail on the ground that crime committed is serious.
