Petitioner was granted provisional admission to the MBA Programme because the result of qualifying examination i.e. B.Com was not declared by concerned University by date of admission.

Clause 3.8 of Admission Brochure shows that all candidates who have appeared in qualifying examination are required to fulfill their eligibility as per eligibility laid down in Admission Brochure latest by 15th October, 2016. Students are also required to give an undertaking/self declaration. Students had to submit final result of qualifying decree on or before 15th October, 2016, failing which provisional admission is to be treated as null and void (cancelled). In instant case also, Petitioner had submitted requisite undertaking/self declaration form. Admittedly, petitioner had not been able to submit result of qualifying examination by 15th October, 2016 which was last date stipulated by the Admission Brochure.

In Pooja Verma Vs. Guru Gobind Singh Indraprastha University & Ors., co-ordinate bench of this Court had held that merely because result of qualifying examination had not been declared in time would not entitle students to subsequently seek admission or appear in semester examination. Said decision has been upheld by Division Bench.

In view of fact that, result of Petitioner of qualifying examination was not submitted to Respondent-University on or before cut off date stipulated by Admission Brochure, action of Respondent in treating admission of Petitioner as cancelled, cannot be faulted. Thus, Petitioner is not entitled to seek that provisional admission be not cancelled or that Petitioner be permitted to provisionally take semester examination.

Relevant : Pooja Verma Vs.
